1. Acceptance of Terms

By accessing or using the Aussie Business AI website at aussiebusinessai.com.au and any related services ("Services"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you must not use our Services.

These Terms constitute a legally binding agreement between you ("you" or "Client") and Aussie Business AI ("we", "us", or "our").

2. Service Description

Aussie Business AI provides the following services to Australian businesses:

  • AI Receptionist: 24/7 automated call answering, enquiry capture, and appointment booking.
  • WhatsApp Automation: Automated messaging, follow-ups, and customer engagement via WhatsApp Business.
  • Booking Systems: Online scheduling and calendar management integrated with your business.
  • Business Process Automation: Workflow automation, lead management, and CRM integrations.
  • AI Chatbot: Website-embedded conversational AI for visitor enquiries and lead capture.

We reserve the right to modify, suspend, or discontinue any part of the Services with reasonable notice.

3. Eligibility

To use our Services, you must:

  • Be at least 18 years of age.
  • Be an Australian business, sole trader, or individual operating within Australia.
  • Have the legal authority to enter into these Terms on behalf of your business (if applicable).

4. Accounts and Access

When you create an account with us, you are responsible for:

  • Maintaining the confidentiality of your login credentials.
  • All activity that occurs under your account.
  • Providing accurate, current, and complete information.
  • Notifying us immediately of any unauthorised access or security breach.

We reserve the right to suspend or terminate accounts that violate these Terms or are used for fraudulent or illegal purposes.

5. Payment Terms

  • All prices are quoted in Australian Dollars (AUD) and are inclusive of GST unless stated otherwise.
  • Subscription plans are billed monthly in advance.
  • Payment is processed via secure third-party payment providers (e.g. Stripe).
  • No lock-in contracts: You may cancel your subscription at any time. Cancellation takes effect at the end of the current billing period.
  • We reserve the right to change pricing with 30 days' written notice.
  • Overdue payments may result in suspension of Services.

6. Intellectual Property

All intellectual property in the Aussie Business AI platform, including but not limited to software, design, branding, AI models, content, and documentation, remains the property of Aussie Business AI.

You retain full ownership of your business data, customer information, and content uploaded to our platform. We do not claim any intellectual property rights over your data.

You grant us a limited licence to process your data solely for the purpose of providing the Services.

7. Limitation of Liability

To the maximum extent permitted by Australian law:

  • Our Services are provided on an "as is" and "as available" basis.
  • We do not warrant that the Services will be uninterrupted, error-free, or free from viruses or other harmful components.
  • Our total aggregate liability to you for any claim arising from these Terms or the Services is limited to the fees you have paid us in the 12 months preceding the claim.
  • We are not liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, revenue, data, or business opportunities.
  • No guarantee of specific results: All examples, estimates, projections, and illustrative figures on our website (including ROI calculators, time-saving estimates, and potential revenue figures) are provided for general informational purposes only and do not constitute a guarantee, promise, or warranty of any particular outcome. Actual results depend on your industry, location, business size, implementation, and many other factors outside our control.

Nothing in these Terms excludes or limits liability that cannot be excluded or limited under Australian Consumer Law.

8. Indemnification

You agree to indemnify and hold harmless Aussie Business AI, its directors, employees, and agents from any claims, damages, losses, or expenses (including legal fees) arising from:

  • Your use or misuse of the Services.
  • Your breach of these Terms.
  • Your violation of any applicable law or regulation.
  • Content or data you provide through the Services.

9. Termination

Either party may terminate the agreement at any time by providing written notice. Upon termination:

  • Your access to the Services will cease at the end of the current billing period.
  • You may request an export of your data within 30 days of termination.
  • We will securely delete your data within 90 days of termination, unless retention is required by law.
  • Any outstanding fees remain payable.

We may immediately terminate or suspend your access if you materially breach these Terms or use the Services for illegal purposes.

10. Governing Law

These Terms are governed by and construed in accordance with the laws of New South Wales, Australia. You agree to submit to the exclusive jurisdiction of the courts of New South Wales for the resolution of any disputes arising under these Terms.

11. Changes to These Terms

We may update these Terms from time to time. Material changes will be communicated via email or a notice on our website at least 30 days before they take effect. Your continued use of the Services after changes are posted constitutes acceptance of the revised Terms.
